Terms of Use for CARFAX® Service History CheckTM

These Terms of Use ("Terms of Use") apply to your use of the CARFAX® Service History Check™. By using the CARFAX® Service History Check™, you acknowledge that (i) you have read these Terms of Use, (ii) you understand them and (iii) you agree (and have the authority to agree), on behalf of your employer, to comply with and be bound by them.

  • CARFAX Service Network. I represent and warrant that my employer is a participating member of the CARFAX program currently named "CARFAX Service Network" (also known as ServiceLink), and I acknowledge and agree that my employer must continue to be a participating member of such program in order for me to use CARFAX® Service History Check™.
  • License; Ownership. CARFAX hereby grants to you, on behalf of your employer, a limited, nontransferable and nonexclusive license to access and use the CARFAX® Service History Check™ solely for you, on behalf of your employer, to determine the service history of your employer's customers' vehicle(s) ("Permitted Use"). You acknowledge that CARFAX® Service History Check™ and all intellectual property relating thereto are and will remain the property of CARFAX.
  • Restrictions on Access and Use; Monitoring. You shall not (i) sell CARFAX® Service History Check™ reports or information derived from the CARFAX® Service History Check™, (ii) share your usernames and passwords with any other person or entity, (iii) permit use of the CARFAX® Service History Check™ by any third party, (iv) use or permit the use of the CARFAX® Service History Check™ in the operation of a service bureau or (v) use the CARFAX® Service History Check™ for anything other than the Permitted Use. Systematic access to or retrieval of information from CARFAX® Service History Check™, including but not limited to the use of "bots" or "spiders," is strictly prohibited. CARFAX reserves the right to monitor your use of the CARFAX® Service History Check™ to ensure compliance with these Terms of Use and prevent fraudulent use.
  • Disclaimers; Limited Warranty.You acknowledge that CARFAX collects data from public records and other sources for use in the CARFAX® Service History Check™ and that this data may contain errors and omissions. CARFAX does not guarantee the correctness or completeness of the CARFAX® Service History Check™, and CARFAX will not be liable for any loss or injury caused, in whole or part, either by its negligence or circumstances beyond its control in procuring, compiling, collecting, interpreting or making available the CARFAX® Service History Check™. You understand that not all information is available for all states and that CARFAX does not have access to some information that may be available to other parties. You also understand that there may be a period of time between receipt of certain information by CARFAX and its inclusion of such information into its database. You acknowledge that the CARFAX® Service History Check™ does not provide any conclusions regarding the condition of any vehicle, and you assume full responsibility with respect to its decisions and transactions using the CARFAX® Service History Check™. You recognize that CARFAX's sole obligation in the case of erroneous data, when notified in writing by you of such erroneous data, is correction of the record in question. CARFAX MAKES AND YOU RECEIVE NO WARRANTIES, EXPRESS OR IMPLIED, AND CARFAX EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
  • Entire Agreement; Modification; Assignment.These Terms of Use constitute the entire agreement with respect to your use of the CARFAX® Service History Check™. CARFAX reserves the right to modify these Terms of Use from time to time by posting a notification on www.service.carfax.com. Such modification will become effective, and will be deemed accepted by you, immediately and automatically upon your use of the CARFAX® Service History Check™ after the modified Terms of Use are posted. You shall not assign the rights or obligations of these Terms of Use under any circumstances.
